1. The LESSOR and LESSEE, in considerationof the rents, covenants, and considerations
which follow do hereby agree as with each other as follows
2. ELIGIBILITY Any person who is a student at St. Cloud StateUniversity may enter into this
Agreement. Exceptions to thispolicy must be approved by the Directorof Residential Life or
his/her designee.
3. This agreement becomes effective at dateof check in and is in effect for the lengthof time
stipulated on thefront of this agreement, as approvedby the Residential Life Office. This
Agreement cannotbe terminated except under the conditions listed in the Termination provi-
sions of this Agreement.
4. PREMISES, ROOM ASSIGNMENTS, SERVICES
A. LESSOR agrees to lease and assignhousing in its residence centers underthe terms stated
in this Agreementand described in the Student Code of Conduct and ResidentialLife
Policies, whichare, by reference, made a part of this Agreement.
B. Room assignments will bemade on the basis of the date that the Application/Agreement is
receivedand, when possible and at thesole discretion of theLESSOR, in accordancewith
preferences that the LESSEE requests. No specific assignmentbased upon LESSEE’s
request isguaranteed. Failure to honor such requests will not voidthis Agreement.
C. LESSOR reservesthe right to consolidate vacanciesby requiring any LESSEE to move
from single occupancy of double rooms todouble/multiple accommodationsin the same
residence center. LESSEE may request permission to use a double occupancy room as a
single room and paythe appropriate scheduled amounton a prorated basis for the remain-
der of the Agreement. Any permission granted herein shallbe evidenced in writing by the
LESSOR.
D. LESSOR reserves the right to changeroom assignments for health, safetyor repair servic-
es, economy or disciplinary reasons involving the LESSEE orfor unresolvable incompati-
bility of roommates. LESSOR further reserves the rightto cancel this Agreement, reenter
the premises, andremove a LESSEE for any violation of theterms of this Agreement or
in the interest of health, discipline,or the general welfare of the residencecenter, LESSEE
or other LESSEES.
E. LESSOR will not discriminate in room assignmenton the basis of race, color, creed, reli-
gion, sexual orientation, nationalorigin, status with regard to publicassistance or disabili-
ty.
F. LESSOR agrees to provide clean habitable premises andto keep said premises in good
repair, including
1. The LESSOR shall install and maintain, in good working order, locks on all doors
leading from livingquarters to hallways and other common areas and to the exterior of
the building.
2. LESSOR shall provide screens, storm windows, and curtains in usable condition for
windows in each room.
3. LESSOR shall provide a bed, mattress, desk and chair in usable condition.
5. A. ROOM RATES are subject to change byaction of the MNSCU Board.
B. DINING SERVICE isnot a part of this Agreement. Cooking facilities areavailable on a
limited basis within each residence hall.
6. PAYMENTS
A. ROOM PAYMENT Any advance paymentpaid by LESSEE at the time of applyingfor
residence hall accommodations shallbe applied to the room rent.
B. LESSEE assumes financial responsibility for all damagesoccurring within his/her room
(normal wear and tearexcepted). Additionally, lessee is responsible for any damages
within the residence hall resulting fromhis/her actions.
C. LESSEE agrees thatcharges for damages done in corridors, stairs, washroomsand other
areas not specifically assigned to anyindividual lessee will be levied equally against all
lessees on the floor,residence center or in the halls unless the responsibility can be
assessed againstparticular individuals.
D. Rental payments are due and payablein full by the Friday of the first week of each
Summer Session. If necessary, paymentin installments may be arranged. If installment
arrangements aremade, a minimum payment of one-halfthe Summer Session charge is
due by the Friday of thefirst week of classes. The remaining Summer Sessionpayment is
due by the Friday of thethird week of classes.
E. If LESSEE is in default on anypayment set forth herein, LESSEE is liable for all legal
costs, charges andattorney’s fees which accrue in obtaining payment.
7. RIGHT OF ENTRY. The LESSOR, it’s officers, employees,and agents shall have the right
to enter upon said assigned premises at reasonable times duringthe summer sessions for the
purpose of inspection and repair, preservation of health,safety and quietude, recovery of
University ownedproperty, to enforce compliancewith rules and regulations, and to insure
building safetyduring break periods.
8. ASSIGNMENT LESSEE shall not assign, sublet or otherwise transfer his/herinterest in this
Agreement withoutthe prior written consent of the LESSOR. Agreements are not transfer-
able from one academic year to another.
9. LESSOR NON LIABILITY: LESSOR is not responsiblefor damage or theft of LESSEE's
personalproperty, including money and/or delivered packages.LESSORencourages LESSEE
to carry appropriate personal propertyinsurance. Additionally,St. Cloud State University, the
Residential Life department and Residence Hall Staffassumes no liabilityfor accidents/injuries
which may occur either in theResidence Hall or whilestudent is participating in any pro-
gram/activity conducted on or off-campus which maybe sponsored all or in part bythe
ResidenceHall Residential Life,Residence Hall Staffand/or St. Cloud State University.
10. GUESTS. LESSEE may have guests,friends and visitors on the premisesas stated in the
Student Code of Conduct and ResidentialLife Policies, but LESSEE shall assure that such
guests, friendsand visitors refrain from acts or practices which unreasonably disturb otherres-
idents or are in violation of any Universityrule or regulation. LESSEE is responsible for the
acts and conduct ofall guests, friends and visitors. Damage caused byguests, friends, and
visitors is the responsibility of the LESSEE who hosted them.
11. MARRIED/FAMILY HOUSING. The residence hall facilities will not accommodate mar-
ried/family housing.
12. RULES AND REGULATIONS.
A. Pets are not permitted in residencehalls at anytime with the exceptionof fish kept in an
aquarium.
B. The possession,use or storage of firearms, fireworks,ammunition, explosives of any type,
alcoholic beverages, illegal drugs,air conditioners, refrigeratorsexceeding 4.0 cubic feet,
flammable liquidsand laboratory specimens are prohibited in the residence centers and on
adjoining grounds.
C. IF LESSEE is responsible for excessivenoise or otherwise interferes withquiet enjoyment
of the residence halland other occupants, LESSEE willbe subject to disciplinary action
and eviction. In addition to otherdisciplinary measures, such LESSEE may be required to
remove stereos,musical instruments and the like fromLESSEE’s assigned room.
D. LESSEE agrees to become aware andobserve all other policies, regulations, and guide-
lines publishedin the Student Handbook and ResidenceHall Handbook, which is by ref-
erence made a part ofthis Agreement.
E. Smoking is not allowed in anyon-campus residence. All buildings are smoke free.
13. UPKEEP
A. The LESSEE agrees to be financiallyresponsible for keeping the room,its furnishings,
windows and doorsclean and free from damage.
B. The LESSEE agreesnot to modify or allow the modificationsof the room or others parts
of the building without prior written approval from the Director of Residential Lifeor
his/her designee.
C. When two or more LESSEES occupy the same roomand responsibility for damages to
the room or contentscannot be ascertained, the damagecharge will be assessed equally
among the LESSEES.
D. LESSEE agrees not to duplicate theroom key and if the key is lost to pay the chargefor
the key and lock corereplacement.
E. LESSEE agrees to use all public areas in a careful manner and to help in assuring their
cleanliness.
F. LESSEE will be financially responsible for any damageor lack of cleanliness caused by
LESSEE to the publicareas.
14. CHECK-IN AND CHECK-OUT
A. LESSEE will, upon occupying a room,complete and sign a Room ConditionForm, which
will be a complete record of the room condition.
B. At the end of the leaseperiod, the room shall be inspected bythe LESSOR and LESSEE
and a comparison madebetween the information contained on the two room condition
reports. Any damages identifiedon the later condition report whichare not contained on
the initial room condition report shallbe attributed to LESSEE. The LESSEE is responsi-
ble for any such damages.
C. Failure to follow thesecheckout proceduresshall resultin the assessment of a $50.00 charge.
D. At the end of the lease period, LESSEEshall provide the LESSOR with a mailingaddress
for mail forwardingpurposes.
E. Room must be vacated at the endof each session per contract dates by thehall closing
times establishedby the LESSOR. LESSEE must vacate his/her room within 24 hours
after the LESSEE’slast final examination.
15. TERMINATION
A. Anagreement for the Summer Session may be terminatedat anytime, with written notice
and payment of a $100.00 cancellation fee. LESSEE will be financially responsible for
the entire lengthof occupancy, which includes that period of time the room is unavailable
to LESSOR. Examples of LESSEE occupancy may include keysnot returned and/or per-
sonal belongingsof LESSEE not removed from the room.
B. No-Show, failureto arrive, or provide written requestfor termination by LESSEE by the
cancellation dates set forth on the frontof this document will result in a $100
administrativecharge to the LESSEE and payment of roomcharges for the period of time
a vacancy exists dueto late cancellation.
C. LESSOR may immediately terminate thisAgreement, reenter and retake thepremises
upon LESSEE’s failure to make paymentsas required under this Agreement or forany
other violationof the terms of this Agreement or any violation of Universityor depart-
mental rules and regulations. Appropriate noticeand appeal procedures are providedto
the LESSEE where termination is based upona violation of such rules and regulations.
Information aboutappeal procedures is availablefrom the Director of Residential Life.
Students dismissed from the hall for violation of these termswill not receive a refund.
16. UNAVAILABILITY OF PREMISES. In the event that any of thepremises which are the
subject of this Agreement, which for thepurposes of this provision shall include any and all
areas in and about theresidence center, should be partially or totally lost,destroyed or other-
wise unavailablebecause of fires, strikes, acts of God,or other events so as to render them
unfit or unavailable in whole or in part forthe purposes of the LESSEE, then eitherthe LES-
SOR or the LESSEE shallhave the right to immediately terminate this Agreement. LESSOR
shall not be liableto the LESSEE for any damages occurringas the result of such termination.
17. The University may revoke this Agreement and/or refer anydisciplinary cases to the
University Judiciary Committee (seeStudent Code of Conduct and Residential Life Policies)
for one or more of the following reasons:
A. Disorderly, unethical, vicious, or immoral conductin or near the residence halls.
B. Misuse, abuse, theft, or destructionof residence hall property.
C. Violation of university policy regarding use and possessionof alcohol beverages.
Violators will besubject to the enforcement policy asestablished and posted in the resi-
dence halls by the Department of Residential Life.
D. Violation of state gambling laws.
E. Possession and/or use ofdrugs and narcotics without a medicalprescription. Violators
will be subject to theenforcement policy as establishedand posted in the residence halls
by the Departmentof Residential Life.
F. General behavior in the residencehalls over a period of time that is indicative that the stu-
dent is not able to adjust to the requirementsof group living.
G. State law prohibits the use of firefighting equipment except in case of fireor during a fire
drill.
Civil Authoritieswill also be used in cases deemed necessary
18. COMPLETE agreement. This Agreement, along withthe Student Code of Conduct and
Residential LifePolicies, which by reference are partof this agreement, represents theentire
Agreement betweenthe parties and no oral promises between the LESSOR and LESSEE are
binding thereon. IN WITNESS WHEREOF the parties have caused this Agreementto be
duly executed intending to be bound thereby.

At the end of the lease period, LESSEE shall provide the LESSOR with a mailing address for mail forwarding purposes. E. Room must be vacated at the end of each session per contract dates by the hall closing times established by the LESSOR. Information about appeal procedures is available from the Director of Residential Life. Students dismissed from the hall for violation of these terms will not receive a refund.

ADVANCE PAYMENT. No room assignment will be made without receipt of both the agreement and advance pre-payment of $100.00.
