Delegated Powers

  • Those powers (expressed, implied, inherent) granted to the National Government by the Constitution

Expressed Powers

  • Those delegated powers of the National Government that are given to it in so many words by the Constitution; also sometimes called the “enumerated powers” - Declare war - Tax - Regulate trade

Implied Powers

  • Those delegated powers of the National Government implied by (inferred from) the expressed powers; those “necessary and proper” to carry out the expressed powers - Necessary and Proper Clause (Elastic Clause) - Regulate the internet - Pass laws/create agencies related to airline travel

Inherent Powers

  • Those delegated powers of the National Government that belong to it because it is the national government of a sovereign state - Make laws regarding immigration - Conduct/prohibit trade with foreign countries

Reserved Powers

  • Those powers held by the States in the American federal system - Grant licenses - Create schools and establish standards - Punish crimes
