Respondent PETITION UNDER SECTION 7 OF THE INSOLVENCY AND BANKRUPTCY CODE, 2016 FOR THE INITIATION OF THE CORPORATE INSOLVENCY RESOLUTION PROCESS (CIRP) AGAINST THE RESPONDENT The Petitioner above-named most respectfully submits as follows:

  1. The present Petition is filed under Section 7 of the Insolvency and Bankruptcy Code, 2016 (IBC) before this Hon'ble Tribunal seeking initiation of the Corporate Insolvency Resolution Process (CIRP) against XYZ PVT LTD a corporate entity incorporated under the laws of India.

7.The Corporate Debtor has, by its actions and failure to respond to demands, demonstrated that it is unable to pay the debt as and when it became due. The Petitioner, therefore, submits that there is sufficient ground to initiate the Corporate Insolvency Resolution Process (CIRP) under Section 7 of the IBC. [PRAYER] The Petitioner respectfully prays that this Hon'ble Tribunal may be pleased to: a. Admit this Petition and initiate the Corporate Insolvency Resolution Process (CIRP) against the Respondent, [xyz pvt ltd], under Section 7 of the Insolvency and Bankruptcy Code, 2016. b. Appoint an Interim Resolution Professional (IRP) to take over the management and affairs of the Corporate Debtor. c. Pass such further orders as this Hon'ble Tribunal may deem fit and proper in the interest of justice.
