Judgement is a basic term used in our daily lives. Generally, it means
analysing a certain situation and forming a notion thereafter. In a legal
sense, judgement is the decision given by the Court, after hearing both
sides, it contains reasons for reaching such a conclusion. The judgement
thus forms an important part of a legal process. A faulty judgement has
the potential to deteriorate the very foundation of the legal justice system
in the country. Therefore it is imperative to study various aspects of
judgment from a judicial point of view.
Object and scope
Chapter XXVII of the CRPC, 1973, deals with Judgment. However there is no
definition of ―judgement‖ present in the Code, but it is to be understood as
the final order of the Court. In the case of Ismail Amir Seikh vs. the State of
Maharashtra, it was held that a judgment is the act of judging. It was pointed
out that judgement should clearly mention the reason for accepting an
argument and rejecting the other.
This chapter is very important as it shed light on the various provisions related
to “judgement” in a Criminal proceeding. This chapter applies all across India.

- If the judgment is passed under the IPC and the judge is not certain
as to under which Section the offence is committed or under which
part of the Section, the judge should specify the same in the
judgement and should pass orders in both the alternate situations.
- The judgement shall furnish a proper reason for the conviction if it is a

Complaint is defined under Section 2(d) of the Code of
Criminal Procedure, 1973 or CrPC as „an allegation made
orally or in writing to a Magistrate, with a view to his taking
action under this Code, that some person, whether known or
unknown, has committed an offence, but does not include a
police report.‟
The explanation to the section further provides that if the
commission of a non-cognizable offence is disclosed in the
investigation report.
The report will then be called the complaint and the officer
who filed the report will then become the complainant.
Section 200, CrPC requires the Magistrate to examine the
complainant and any witness under oath before putting it down in
writing. The written complaint will then be signed by the
complainant and the aforementioned witnesses.

Whhaatt iiss TTrriiaall??
The word “trial” is not defined anywhere in the Criminal Procedure Code,
however, it means a commonly understood stage of trial which begins after
framing the charge and ends with the conviction or acquittal.
In simple words, trial can be defined as a formal examination of evidence by
a judge, typically before a jury, in order to decide guilt in a case of criminal
or civil proceedings.

The trial of the accused in the Indian Criminal Law is divided
through the punishments of the said committed offence. The Trial of the
accused for the offence committed by him is divided into four types.
Session Trial – If the offence committed is punishable with more
than seven years of imprisonment or Life imprisonment or Death, the
trial is to be conducted in a Sessions court after being committed or
forwarded to the court by a magistrate.

Warrant Trial – Warrant case includes offence punishable with the
death penalty, imprisonment for life and imprisonment exceeding two
years. A trial in a warrant case begins either by filing an FIR in a Police
Station or by filing it before a Magistrate.

Summon Trial- If the offence committed is punishable with less
than two years of imprisonment, it is taken as a summons case. In
respect of this offence, it is not necessary to frame charges. Summon is
issued by the Magistrate to the accused under section 204(1) (a) of
Cr.P.C, 1973. “Summon case” means a case relating to an offence, not
being a warrant case. The procedure to deal with such matter provided
in section 251 to 259 of Cr.P.C, 1973 which is not as serious/formal as
other trials (Session trial, warrant case instituted on the police report
and warrant cases instituted otherwise than on police report).

Summary Trial – Those trials in which cases are disposed of
speedily with a simple procedure to follow and recording of such trials
are done summarily. In this trial only small cases are taken in hand and
complicated cases are reserved for summon and warrant trials. Legal
