Introduction to Rosco Pound

Rosco Pound was a prominent legal scholar known for his influential work in jurisprudence and sociological

jurisprudence.

POUND’s LEGAL PHILOSOPHY (^1) Pound's legal philosophy was centered round the functional aspect of law, which in other words , meant "Law in action". (^2) He preferred to describe describe sociological jurisprudence as experimental jurisprudence and focused on the application of law to social realities of life. 3 Pound emphasized that law should be studied in the the context of History , Sociology, Economics, and and Psychology as well as the traditions, customs, and and needs of each society.

Pound's Theory of Social Engineering Rosco Pound considered law as a"Social Engineering", to accelerate the process of social ordering by making all possible efforts to avoid conflicts of interest of individuals in the society. Pound enumerated various interests that the law should seek to protect and classified them into 3 categories.

  • Private interest
  • public interest
    • social interest

PRIVATE INTEREST.

➢ 1) Individual's interest.

➢ 2)Interest in domestic relations.

➢ 3)Interest in subsistence.

PUBLIC INTEREST. ➢ 1)Interest in the preservation of the state as such; and ➢ 2) The state has the guidance of social interest such as administration of Trust, charitable endowments, protection of natural environment, regulation of public employment, and so on SOCIAL INTEREST.

➢ 1)Interest in the preservation of peace, general health, security of transactions, etc.

➢ 2)Preserving social Institutions such as religion, political and economic institutions, etc.

➢ 3) Interest in preserving general morals by prohibiting transactions that are against

morality such as drunkenness, gambling, etc.

➢ 4)Interest in conservation of social resources.

➢ 5)Social interest is general progress including economic, political, and cultural progress.

Criticisms Against Rosco Pound’s Theory. 1 Dr. Allen Criticized the utilitarianism in Pond's theory as it confines the interpretation of 'wants and desire' to only the material Welfare of an individual's life completely ignoring the personal freedoms which are equally important for a happy social leaving 2 Dr. Friedmann He expressed his doubts about the value of classification of interest and remarked that "there is a danger of implicit grading of interest as either individual, public and social because these are the changing conceptions as been accepted by Pond himself. Not only that, the respective value of these interests and their evaluation also depends on the changing of the political and legal system".
