Discussion on the Role and Rewards of Being a Lawyer in Large and Small Firms - Prof. Mark, Study notes of Political Science

A part of a lawyer's seminar and includes three thought-provoking questions about the profession. The questions discuss the importance of litigation cases in large firms, the dependence of lawyers on law books, and the rewards of joining a small firm instead of a large one.

Robbie Lopez
Lawyer’s seminar
Questions #3
1) Rhode in the previous book spoke about the profession and being professional, do
you believe that it is part of a lawyer’s profession in a big firm to work with
litigation cases rather than referring them, or avoiding them totally? “Litigation
occupies less than one-tenth the time of a large law firm and reported that some
firms avoid it entirely.” (32) Or do you think in order to maintain that
professionalism, lawyers from big law firms should focus on certain cases?
2) Francis N. Bangs said “no man is fit to practice law who is not able to practice it
without law books”. (8) Lawyers of today are very dependent on the adjudged
cases and books. Does that make them an inferior lawyer? Does it make them un-
professional? Or is it just because of the many different cases including the
corporate sectors?
3) What is the reward of joining a small firm? Wouldn’t you rather join the
promotion-to-partner tournament where the program provides incentive for
associates to work hard? The large firms promote a constant percentage of each
class to partner at the end of a fixed period of time. The smaller firms have no
surplus, shareable human capital and are required to retire at a particular age.
